Tax Treatment of Annuity Income in New York

New York taxes annuity income as ordinary income. However, New York excludes up to $20,000 of private pension and annuity income from state taxes for residents age 59½ and older.

New York exempts government pensions and allows those 59 1/2 and older to exclude up to $20,000 of private pension and annuity income; the rest is taxed as ordinary income.

Remember that federal taxes still apply regardless of your state. For non-qualified annuities, only the earnings portion is taxed (the "exclusion ratio" shelters your original investment).
